A construction company has sued the downtown revitalization non-profit Main Street Perryville for more than $71,000.

Jason Pruitt, of Pruitt Construction & Excavation LLC claims the organization “breached” its verbal agreement to pay for labor and materials to restore property it owns on Merchant’s Row for more than $71,000.

According to the lawsuit filed on Jan. 9 of this year, on or about Jan. 13, 2018, Pruitt furnished the materials and began repairing and restoring the building owned by MSP known as The Opera House, 302 South Buell Street, “pursuant to a verbal agreement between the parties. The defendants made some payments on the materials and services performed pursuant to the agreement.”

The last payment was allegedly made Nov. 20, 2018.

The lawsuit states that Pruitt last provided materials and labor for the project on Jan. 17, 2019, then demanded payment based on the verbal agreement.

Pruitt filed a mechanics lien against MSP in the Boyle County Clerk’s office on Feb. 8, 2019. 

Because MSP has not made any payments since 2018, according to the lawsuit, Pruitt has asked for a judgment against Main Street Perryville for $71,881.12, plus 6% annual interest from Jan. 2018 and all costs and fees.

The lawsuit also asks for the property to be sold by the Boyle County master commissioner to pay off the debt owed.

MSP Executive Director Vicki Goode said it’s the organization’s policy to not comment on any litigation and the matter has been turned over to MSP’s attorney.
